Spaceful Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of Spaceful (the “App”) and related websites, features, products, and services provided by Kiwi Game Studio (“we,” “us,” or “our”). Our website is available at https://www.kiwigamestudio.com/.

By downloading, installing, accessing, or using Spaceful, you agree to these Terms. If you do not agree to these Terms, do not use the App.

Important: Spaceful may help you review and delete device content such as photos, videos, screenshots, contacts, or other storage items. You are responsible for reviewing items before confirming deletion. Deleted items may not always be recoverable.

1. Eligibility

You must be at least 13 years old, or the minimum legal age required in your jurisdiction, to use Spaceful without parent or guardian consent. If you are under the required age, you may use the App only with permission and supervision from a parent or legal guardian.

If you use Spaceful on behalf of another person or organization, you represent that you have authority to accept these Terms on their behalf.

2. App Functionality

Spaceful is designed to help users review, organize, and manage device storage. Depending on the App version, device permissions, and features you choose to use, Spaceful may help identify duplicate, similar, large, or unwanted items, such as photos, videos, screenshots, contacts, or other local content.

The App provides suggestions and tools for your convenience. We do not guarantee that every suggestion will be accurate, complete, or suitable for your needs. You should carefully review all items before deleting, merging, editing, or otherwise changing them.

3. Device Permissions and Local Content

Certain features require access to device content or device permissions, such as Photos, Contacts, storage-related information, notifications, or similar permissions. You can grant, limit, or revoke permissions through your device settings.

You retain ownership of your photos, videos, contacts, files, and other content. You are responsible for ensuring that you have the right to access, manage, modify, or delete any content that you process through the App.

4. Deletion, Recovery, and Backups

Spaceful may provide tools that help you delete or organize content. Deletion behavior may depend on your device, operating system, App version, content type, system settings, cloud synchronization, and whether the item is moved to a temporary recovery location such as a “Recently Deleted” folder.

Before using cleaning or deletion features, you should back up important content. We are not responsible for loss of photos, videos, contacts, files, memories, business information, or other data resulting from your use of the App, your choices, device settings, cloud sync behavior, or third-party services.

5. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use Spaceful for your personal, non-commercial use on devices you own or control.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, attempt to extract source code from, or create derivative works based on Spaceful, except to the extent such restrictions are prohibited by applicable law.

6. Acceptable Use

You agree not to use Spaceful or our website to:

Violate any applicable law, regulation, third-party right, or platform rule.
Interfere with, damage, overload, disrupt, or compromise the App, website, servers, networks, or security systems.
Attempt to gain unauthorized access to any system, account, data, or service.
Use automated tools, scraping, bots, or similar methods to access or misuse the App or website.
Upload, transmit, or introduce malicious code, malware, spyware, or harmful content.
Misrepresent your identity, affiliation, or authorization.
Use the App in a way that could harm us, other users, Apple, service providers, or third parties.

7. Purchases, Subscriptions, and Trials

Spaceful may offer free features, paid features, in-app purchases, subscriptions, free trials, promotional offers, or other paid services. Availability, pricing, features, and billing terms may vary by country, region, App version, device, platform, and promotional period.

a. App Store Billing

If you purchase a subscription or in-app purchase through the Apple App Store, your payment will be processed by Apple, not by us. Your purchase is subject to Apple’s payment terms, refund rules, and subscription management procedures.

b. Auto-Renewing Subscriptions

If Spaceful offers auto-renewing subscriptions, your subscription will automatically renew unless you cancel it through your Apple ID subscription settings before the renewal deadline shown by Apple. You can manage or cancel subscriptions in your device settings or through your Apple account.

c. Free Trials and Promotional Offers

If a free trial or promotional offer is provided, the terms of that offer will be shown at the time of purchase or enrollment. Unless canceled before the end of the trial period according to Apple’s rules, a trial may convert into a paid subscription.

d. Refunds

Refund requests for purchases made through the App Store must be submitted to Apple, unless applicable law requires otherwise. We do not control Apple’s refund decisions.

8. Third-Party Services

Spaceful may rely on or link to third-party services, software, platforms, analytics tools, crash-reporting tools, advertising networks, subscription services, cloud services, or websites. Third-party services are governed by their own terms and privacy policies.

We are not responsible for third-party services, including their content, availability, security, data practices, billing practices, or performance.

9. Privacy

Your use of Spaceful is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect information. Please review the Spaceful Privacy Policy.

10. Intellectual Property

Spaceful, including its design, software, code, graphics, interface, trademarks, logos, text, and other materials, is owned by Kiwi Game Studio or our licensors and is protected by intellectual property and other laws.

Except for the limited license granted in these Terms, we do not grant you any rights to our intellectual property. You may not use our name, logos, branding, or trademarks without our prior written permission.

11. Feedback

If you provide feedback, suggestions, ideas, bug reports, or feature requests, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, copy, modify, publish, and incorporate that feedback for any purpose without obligation to compensate you.

12. Updates and Changes to the App

We may update, modify, suspend, or discontinue Spaceful or any feature at any time. Updates may add, remove, or change features, requirements, pricing, or compatibility. Some features may not be available on all devices, operating systems, App versions, regions, or languages.

You are responsible for keeping your device, operating system, and App version updated as needed for security and compatibility.

13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Spaceful and our website are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory.

We do not warrant that the App will be uninterrupted, error-free, secure, accurate, complete, compatible with every device, or that it will meet your expectations. We do not warrant that storage suggestions, duplicate detection, similarity detection, cleanup recommendations, or other App results will be perfect or free from mistakes.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Kiwi Game Studio and its owners, employees, contractors, partners, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, content, photos, videos, contacts, revenue, profits, business, goodwill, or device functionality arising from or related to your use of or inability to use Spaceful.

To the maximum extent permitted by applicable law, our total liability for any claim arising from or related to these Terms or Spaceful will not exceed the amount you paid for Spaceful during the twelve months before the event giving rise to the claim, or USD $50, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

15. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Kiwi Game Studio and its owners, employees, contractors, partners, licensors, and service providers from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to your use of Spaceful, your violation of these Terms, your content, or your violation of any law or third-party right.

16. Termination

These Terms remain in effect until terminated. You may stop using Spaceful at any time and delete the App from your device. We may suspend or terminate your access to the App or any feature if we believe you have violated these Terms, created risk or legal exposure, or used the App in a harmful or unlawful way.

Sections that by their nature should survive termination will survive, including sections related to intellectual property, feedback, disclaimers, limitation of liability, indemnification, and dispute-related provisions.

17. Apple-Specific Terms

If you download Spaceful from the Apple App Store, you acknowledge that these Terms are between you and Kiwi Game Studio, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App.

Your use of the App must comply with the App Store rules and any applicable Apple terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary where applicable.

18. Governing Law and Disputes

These Terms are governed by the laws applicable in the place where Kiwi Game Studio is established, except where applicable consumer protection laws require another law to apply. Nothing in these Terms limits any consumer rights that cannot be waived under applicable law.

Before filing a formal claim, you agree to contact us first and try to resolve the dispute informally. We will also try to resolve disputes with you informally and in good faith.

19. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the “Last updated” date above. If changes are material, we may provide notice through the App, our website, or other appropriate means.

Your continued use of Spaceful after updated Terms become effective means you accept the updated Terms.
